Terms of Service

These Terms of Service apply when you visit, use or make a purchase from the Crossways Wool & Fabrics website.

This website is operated by Woolly Boolly Pty Ltd, trading as Crossways Wool & Fabrics. Throughout these Terms, “Crossways Wool & Fabrics”, “we”, “us” and “our” refer to Woolly Boolly Pty Ltd trading as Crossways Wool & Fabrics.

By using this website, creating an account or placing an order, you agree to these Terms, along with our Privacy Policy and Shipping & Returns Policy.

If you do not agree with these Terms, you should not use this website.

1. Using our website

You may use our website for personal and lawful purposes.

You must not:

  • use the website for any unlawful, fraudulent or harmful purpose
  • interfere with the security or operation of the website
  • introduce viruses, malicious code or other harmful material
  • attempt to gain unauthorised access to the website or its systems
  • scrape, copy or extract website content or product information for commercial use
  • use automated systems to place orders, harvest information or disrupt the website
  • impersonate another person or provide false or misleading information
  • infringe our rights or the rights of another person.

We may suspend or restrict access to the website where we reasonably believe these Terms have been breached.

2. Accounts and customer information

You may be able to create an account or purchase as a guest.

You are responsible for ensuring the information you provide is accurate, complete and current. This includes your name, contact details, billing information and delivery address.

You are responsible for keeping your account details and password secure. Please contact us promptly if you believe someone has accessed your account without permission.

We are not responsible for delays or additional costs caused by incorrect or incomplete information supplied by you.

3. Product information

We take reasonable care to ensure that product descriptions, photographs, measurements, colours, prices and other information on our website are accurate.

However:

  • colours may appear differently depending on your screen, device and display settings
  • handmade and natural products may have minor variations
  • yarn colours may vary between dye lots
  • product packaging may change from time to time
  • images may be illustrative and may not show the product at its exact size
  • measurements and quantities may be approximate where stated.

When purchasing yarn for a single project, we recommend ordering enough yarn at the same time so that we can provide balls from the same dye lot where possible. We cannot guarantee that the same dye lot will be available for later orders.

It is your responsibility to review product descriptions and determine whether a product is suitable for your intended project. You are welcome to contact us before ordering if you need assistance.

Nothing in this section limits your rights under the Australian Consumer Law.

4. Availability

All products are subject to availability.

Occasionally, an item may become unavailable after you place an order due to a stock discrepancy, supplier issue or other circumstances.

If we cannot supply an item, we will contact you and offer an appropriate solution, which may include:

  • a suitable alternative
  • waiting for the item to become available
  • removing the unavailable item from your order
  • a refund for the unavailable item.

We may limit the quantity of a product available to any customer, household, geographic area or order where reasonably necessary.

5. Prices and payment

Unless stated otherwise, all prices are in Australian dollars and include GST where applicable.

Delivery charges and any other applicable fees will be shown before you complete your purchase.

Prices, promotions and discounts may change without notice. The price that applies to your order is generally the price displayed when your order is placed.

Prices available online may occasionally differ from prices available in our physical store.

You must use a payment method that you are authorised to use. Payment must be successfully processed before we are required to fulfil an order.

6. Orders

Placing an order is an offer to purchase products from us.

You will normally receive an automated confirmation after placing your order. This confirms that we have received the order but does not necessarily mean that we have accepted it.

We may decline or cancel an order before dispatch where reasonably necessary, including where:

  • a product is unavailable
  • there is an obvious pricing or product information error
  • payment cannot be processed
  • we suspect fraud or unauthorised activity
  • the order appears to be intended for unauthorised commercial resale
  • we cannot deliver to the supplied address.

If we cancel an order after receiving payment, we will refund the affected amount using the original payment method.

Please check your order carefully before submitting it. Once an order has been prepared, dispatched or made available for download, we may not be able to change or cancel it.

7. Pricing and website errors

Occasionally, our website may contain a typographical error, incorrect price, inaccurate description or incorrect availability information.

We may correct errors and update information at any time.

Where an obvious error affects an order, we may contact you to confirm whether you wish to proceed using the correct information or cancel the affected item for a refund.

Nothing in this section allows us to engage in misleading or deceptive conduct or limits your rights under the Australian Consumer Law.

8. Shipping and delivery

Shipping costs, estimated delivery timeframes and other delivery information are set out in our Shipping & Returns Policy.

Delivery timeframes are estimates and may be affected by courier delays, weather, peak periods, regional delivery conditions and events outside our reasonable control.

We will take reasonable steps to assist where an order is delayed, lost or damaged in transit.

You are responsible for providing a complete and accurate delivery address. Additional delivery costs resulting from an incorrect address, rejected delivery or failure to collect a parcel may be charged to you where permitted by law.

9. Returns, exchanges and refunds

Our change-of-mind returns, exchanges and store credit conditions are set out in our Shipping & Returns Policy.

Our voluntary returns policy applies in addition to your rights under the Australian Consumer Law.

Nothing in these Terms or our Shipping & Returns Policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

10. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, you may be entitled to a repair, replacement, refund, resupply or other remedy if a product or service does not meet an applicable consumer guarantee.

Your rights will depend on factors including the nature of the problem and whether it is a major or minor failure.

We may ask you to provide reasonable evidence of purchase and information about the issue so that we can assess your claim.

These rights apply in addition to any rights provided under our voluntary policies or a manufacturer’s warranty.

11. Downloadable patterns and digital products

Digital products may include downloadable knitting patterns, crochet patterns, sewing patterns and other electronic materials.

You are responsible for checking the product description, format, language, skill level and any listed material or software requirements before purchasing.

Once payment has been processed, your digital product will usually be delivered through an email, customer account or download link.

Because digital products are supplied immediately and cannot be physically returned, we do not provide change-of-mind refunds after the download or access link has been supplied.

This does not limit your rights under the Australian Consumer Law. Please contact us if:

  • the file is faulty or corrupted
  • you receive the wrong product
  • the product is materially different from its description
  • you cannot access the download because of a problem within our control.

You are responsible for providing a valid email address and checking your junk or spam folder. Please contact us if your download does not arrive within a reasonable period.

Unless a product listing states otherwise, purchasing a digital product grants you a limited, personal, non-exclusive and non-transferable licence to use it for your own personal purposes.

You must not:

  • copy, reproduce or distribute the digital product to another person
  • upload it to a website, social platform, file-sharing service or online group
  • sell, sublicense or commercially redistribute it
  • remove copyright or ownership notices
  • claim the design or content as your own.

Whether finished items made from a pattern may be sold will depend on the licence terms provided with that particular pattern.

Patterns may be owned by Crossways Wool & Fabrics or licensed to us by their designer or publisher. Any additional terms included with a pattern will also apply.

12. Gift cards

Gift cards may be purchased and redeemed subject to the conditions displayed when they are issued.

Unless a longer period is stated, gift cards will remain valid for at least three years from the date of purchase, in accordance with Australian law.

Gift cards:

  • may be used toward eligible purchases from Crossways Wool & Fabrics
  • are not redeemable for cash, except where required by law
  • cannot generally be used to purchase another gift card
  • cannot be replaced if lost, stolen or used without permission, unless required by law
  • cannot be cancelled or refunded for change of mind after issue
  • may be used over more than one transaction while a balance remains.

If the value of a purchase exceeds the available gift card balance, the remaining amount must be paid using another accepted payment method.

Promotional vouchers, discount codes, store credits and gift cards supplied without payment may have different conditions and expiry periods where permitted by law. Any applicable conditions will be stated when they are issued.

We may cancel or suspend a gift card where we reasonably suspect fraud, unauthorised use or an error in its issue. Where a legitimately purchased gift card is affected, we will provide an appropriate replacement or remedy.

13. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions, including eligibility requirements, minimum spending amounts, applicable products and expiry dates.

Unless otherwise stated:

  • only one discount code may be used per order
  • discounts cannot be applied retrospectively
  • discounts do not apply to gift cards
  • promotions are available while stocks last
  • promotional offers cannot be exchanged for cash.

If promotional terms conflict with these Terms, the specific promotional terms will apply to that promotion.

14. Classes and events

Classes, workshops and events are subject to separate booking terms and policies.

Where you book a class or event through our website, the relevant class or event terms will apply in addition to these Terms.

15. Third-party services and links

Our website may contain links to third-party websites or use services provided by third parties, including Shopify, payment providers, delivery providers and social media platforms.

Third-party services may be governed by their own terms and privacy policies.

We are not responsible for the content, availability, security or practices of third-party websites that we do not control. Accessing a third-party website is at your discretion.

Crossways Wool & Fabrics is the seller responsible for purchases made from our store. Shopify provides the ecommerce platform used to operate the website but is not the seller of our products.

16. Intellectual property

Unless otherwise stated, the content on this website is owned by or licensed to Crossways Wool & Fabrics.

This includes our branding, logos, text, photographs, graphics, illustrations, product descriptions, website design and downloadable materials.

You may view and use the website for personal and non-commercial purposes.

You must not reproduce, republish, modify, distribute, sell, commercially exploit or create derivative works from our website content without our prior written permission or the permission of the relevant rights holder.

Product names, brand names, patterns and other materials belonging to third parties remain the property of their respective owners.

17. Reviews and other submitted content

If you submit a review, photograph, comment or other content to us, you confirm that:

  • you created it or have permission to submit it
  • it is accurate and not misleading
  • it does not infringe another person’s rights
  • it is not unlawful, defamatory, threatening, offensive or malicious
  • it does not contain advertising, spam, viruses or harmful code.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display submitted content for the purpose of operating and promoting our business.

We may moderate or remove submitted content where we reasonably consider it inappropriate, unlawful, misleading or in breach of these Terms.

18. Website availability and security

We aim to keep the website accurate, secure and available, but we do not guarantee that it will always operate without interruption, delay or error.

We may update, suspend or withdraw parts of the website for maintenance, security or operational reasons.

You are responsible for using suitable security software and protecting your own device, account and internet connection.

19. Disclaimer and limitation of liability

To the extent permitted by law, information available through our website is provided for general information only.

Project suggestions, yarn estimates, pattern guidance and other recommendations may depend on individual materials, techniques, tension, measurements and circumstances. You should consider whether a product or recommendation is suitable for your particular needs.

To the extent permitted by law, we are not liable for indirect or consequential loss arising from your use of the website or products purchased through it.

Where the Australian Consumer Law allows our liability to be limited, our liability may be limited, at our option, to an appropriate remedy such as replacing or resupplying the affected goods or services or paying the reasonable cost of doing so.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

20. Privacy

Our collection, use and handling of personal information is explained in our Privacy Policy.

Because our website is hosted by Shopify, information may also be processed by Shopify and other service providers involved in operating the website, processing payments and fulfilling orders.

21. Changes to these Terms

We may update these Terms from time to time by publishing an updated version on this page.

The updated Terms will apply from the date shown at the top of the page. Changes will not retrospectively alter an order that we have already accepted unless required by law or agreed with you.

You should review these Terms periodically.

22. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be read down or removed to the minimum extent necessary.

The remaining provisions will continue to apply.

23. Governing law

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia.

You and Crossways Wool & Fabrics submit to the jurisdiction of the courts of Western Australia and any courts that hear appeals from them.
